This Public Offer is published at https://store.snaystrike.com/en/offer.
Effective date of this version: to be specified.
1. General description of the service
1.1. The Official Snay Strike Store (the “Store”) is a service for purchasing Additional Game Features, including packs of the paid in-game currency Strikes, to be credited to the Game Profile of a chosen Recipient.
1.2. The Store operates on the website at store.snaystrike.com (the “Store Website”). The main website of the Game is located at snaystrike.com (together with the Store Website, the “Website”).
1.3. The Store is operated by the seller (the “Seller”): name — to be specified, country of registration — to be specified, registration number — to be specified, address — to be specified.
1.4. The legal basis on which the Seller provides Additional Game Features and its relationship with the Rights Holder: to be specified.
1.5. The Store enables any natural person with legal capacity who uses the Website (the “User”) to obtain Additional Game Features for a fee, for the User's own Game Profile or for the Game Profile of another Recipient.
1.6. This public offer (the “Offer”) governs only the purchase of Additional Game Features in the Store. Use of the Game, including credited Strikes, is governed by a separate agreement — the Terms of Use (https://snaystrike.com/en/terms), which are accepted when using the Game; placing an Order is not an acceptance of them. The collection and processing of personal data and the use of cookies are governed by the Privacy Policy (https://snaystrike.com/en/privacy).
1.7. By placing an Order, the User accepts the terms of the Offer and of other documents expressly designated on the Website as part of the purchase terms. How personal data is processed is described in the Website Privacy Policy (https://snaystrike.com/en/privacy).
1.8. Where third parties, including the Payment Provider, take part in the use of the Store, the User also complies with their terms, which the User reviews when using their services.
1.9. The Offer at the address stated above is always presented in its latest version. The procedure for amending the Offer and the version applicable to a particular Order are set out in Section 11.
2. Terms and definitions
2.1. “Game” means the Snay Strike computer game for mobile devices, including its server side and related services.
2.2. “Game Profile” means a player's unique profile in the Game, on which the player's in-game currency, items and progress are recorded.
2.3. “Player ID” means the public numeric identifier of a Game Profile that is displayed in the Game and is used in the Store only to select a Recipient. A Player ID is not a login, a password or any other means of authentication; it does not confirm any right to a Game Profile and does not give access to it.
2.4. “Recipient” means the Game Profile to which Additional Game Features are credited under an Order. The Recipient may be the User's own Game Profile or the Game Profile of another player.
2.5. “Strikes” means the paid in-game currency of the Game. Strikes are not money, electronic money or a means of payment, have no monetary value outside the Game and are used only within the Game under its rules.
2.6. “Additional Game Features” means the packs of Strikes and other in-game content offered on the Store Website, whose list, description and price are stated on the Store Website.
2.7. “Order” means the User's request, placed using the functionality of the Store Website, to obtain the Additional Game Features selected on the Store Website for the specified Recipient.
2.8. “Game Server Side” means the hardware and software systems that keep the records of Game Profiles, Strikes balances, items and progress. Only the Game Server Side creates Orders, records the payment result and performs Crediting; information from the User's browser is not a basis for doing so.
2.9. “Payment Provider” (name — to be specified) means a third party that accepts payment for an Order on its payment page and reports the result to the Game Server Side.
2.10. “Confirmed Payment” means payment for an Order whose result the Game Server Side has received and verified directly from the Payment Provider over a secure channel. The return page of the payment service, a message in the browser or a screenshot is not confirmation of payment.
2.11. “Crediting” means the recording of the Additional Game Features of an Order on the Recipient's Game Profile, performed by the Game Server Side.
2.12. “Test Mode” means the mode in which the Store operates before real payments are launched: payment is simulated, no money is charged and no Strikes or other values are credited (Section 11).
2.13. “Rights Holder” means the person holding the exclusive rights to the Game and the Additional Game Features, as determined in accordance with clause 1.4.
2.14. “Parties” means the Seller and the User together.
3. Conclusion of the contract
3.1. The Offer is the Seller's public proposal to conclude a contract on the terms set out herein with any User in accordance with applicable law.
3.2. The Offer is accepted by placing an Order on the Store Website and paying its full price. The contract is deemed concluded at the moment of Confirmed Payment for the Order. No signature of a paper document, electronic signature or exchange of additional messages is required for this.
3.3. The contract is concluded on the terms of the Offer as a whole, without exceptions or reservations, to the extent permitted by applicable law.
3.4. An Order placed in Test Mode is not an acceptance of the Offer and does not give rise to a contract or to any obligation to pay or to perform Crediting.
3.5. The User confirms having the legal capacity sufficient to conclude and perform the contract under the laws of the User's country. If the User has not reached the age of full legal capacity, the Order is placed with the consent and participation of the User's parent or other legal representative, who reviews the Offer and the other documents of the Website and accepts the Offer.
3.6. To the extent permitted by applicable law, the legal representatives of minors are responsible for the actions of minors taken without their consent.
3.7. The Seller may restrict access to the Store or to particular Additional Game Features depending on age where required by applicable law or the rules of the Game.
4. Order placement
4.1. To place an Order, the User successively:
- 4.1.1. selects Additional Game Features and their quantity on the Store Website;
- 4.1.2. enters the Recipient's Player ID, checks the public profile found for it (nickname and avatar) and explicitly confirms the Recipient;
- 4.1.3. enters an email address for the receipt and other notices about the Order;
- 4.1.4. reviews the Offer and the Privacy Policy;
- 4.1.5. proceeds to payment and pays for the Order on the Payment Provider's page.
4.2. Entering a Player ID is not a sign-in to the Game Profile and does not confirm that the User owns that profile. The User may place an Order both for the User's own Game Profile and for the Game Profile of another player.
4.3. When an Order is created, the Game Server Side checks the Recipient's Player ID again. If the Game Profile is not found or cannot receive Additional Game Features, the Order is not created. The result of such a check shown earlier on the Website or saved in the browser does not replace it.
4.4. The User is solely responsible for the correctness of the Player ID entered and of the Recipient confirmed, as well as of the email address. Before confirming, the User must make sure that the nickname and avatar of the profile found match the intended Recipient.
4.5. By placing an Order, the User confirms having been informed about the Additional Game Features: their description, the contents of the Order, the Recipient, the Crediting procedure and the full price.
4.6. To the extent permitted by applicable law, the Seller is not liable for Crediting to another Game Profile if the User entered and confirmed its Player ID.
4.7. The tax obligations of the Parties related to the contract are determined by applicable law.
5. Price and payment
5.1. The price of each item of Additional Game Features is stated on the Store Website. Price currency and taxes included in the price: to be specified.
5.2. The Seller may change prices unilaterally. The price of an Order is fixed by the Game Server Side when the Order is created; a subsequent change of prices on the Website does not affect an Order already created.
5.3. An Order is paid in full, in a single payment. The purchase is made of the User's own free will.
5.4. Payment is made on the Payment Provider's payment page by the methods it offers. Bank card details are entered only on the Payment Provider's side; the Seller does not receive or store the card number, its expiry date or its security code.
5.5. Returning from the Payment Provider's page to the Website is for information only and does not in itself mean payment. An Order is deemed paid only after Confirmed Payment.
5.6. The Seller may grant discounts and run promotions, determining their terms and periods. The terms of a promotion apply to an Order if they were in effect when the Order was created.
5.7. Any fraudulent or unlawful activity related to payment is prohibited, including the use of another person's means of payment without their owner's permission. Where there are reasonable indications of such activity, the Seller may refuse to perform an Order or cancel it with a refund of the payment received in the manner provided by applicable law.
5.8. The Seller may withhold Crediting until Confirmed Payment of the Order in full.
5.9. A receipt or other payment document is sent to the email address stated in the Order where provided for by applicable law and the Payment Provider's terms. Consent to receive advertising and informational mailings is not a condition of an Order and is given separately.
5.10. In case of technical difficulties with payment, the User may contact support at support@snaystrike.com or through the page https://snaystrike.com/en/support, stating the Order number if known.
6. Provision of additional game features
6.1. An Order passes through separate states that the Game Server Side records independently: created and awaiting payment; payment confirmed; fulfilled (Crediting performed); payment failed or cancelled; refunded. No state substitutes for another: for example, Confirmed Payment does not yet mean that Crediting has been performed.
6.2. After Confirmed Payment, the Game Server Side performs Crediting to the Recipient's Game Profile stated in the Order. Each Order is fulfilled once: repeated notices from the Payment Provider do not lead to repeated Crediting.
6.3. Crediting period, counted from the moment of Confirmed Payment: to be specified.
6.4. In case of technical malfunctions, the Crediting period may be extended by the time needed to eliminate them. Once the malfunctions are eliminated, the Seller performs Crediting.
6.5. To use the Additional Game Features, the Recipient:
- 6.5.1. launches the Game;
- 6.5.2. signs in to the Recipient's Game Profile by the means provided by the Game (the Player ID is not used for this);
- 6.5.3. uses the credited Strikes and other content under the rules of the Game for personal, family and other needs not related to business activity.
6.6. The Seller's obligation under an Order is deemed fulfilled at the moment of Crediting, regardless of whether the Recipient has used the Additional Game Features.
6.7. The Seller is not liable for the technical capabilities of the devices of the User and the Recipient, or for the operation of communication networks and third-party services beyond the Seller's control.
6.8. If Crediting was performed in error as a result of a technical failure (for example, repeatedly or in a larger amount than paid for), the Seller may adjust the Recipient's balance within the extent of the error, in the manner permitted by applicable law.
6.9. In case of a breach of the Crediting procedure or technical failures, the User reports it to support at support@snaystrike.com or through the page https://snaystrike.com/en/support, stating the Order number and the Recipient's Player ID.
7. Order refunds
7.1. The User may withdraw from an Order before paying for it, simply by not paying. An unpaid Order is not fulfilled and may be cancelled automatically.
7.2. Whether and how money is refunded after Crediting is determined by applicable law, including its mandatory rules, and by the following terms: to be specified.
7.3. If, after Confirmed Payment, the Seller cannot perform Crediting (for example, the Recipient's Game Profile can no longer receive Additional Game Features), the Seller refunds the amount paid to the User in full.
7.4. Money is refunded by the same method by which the Order was paid, through the Payment Provider. The time for the funds to arrive depends on the Payment Provider and the User's bank.
7.5. When money is refunded for Additional Game Features already credited, the Seller may debit the corresponding Strikes and other content from the Recipient's Game Profile to the extent of the refund, in the manner permitted by applicable law.
7.6. If a payment for an Order is disputed through a bank or the Payment Provider, the Seller may suspend the performance of the Order until the dispute is resolved, to the extent permitted by applicable law.
7.7. A refund request is sent to support@snaystrike.com, stating the Order number, the Recipient's Player ID and the reason for the request.
8. Intellectual property
8.1. The exclusive rights to the Game, the Website, the Additional Game Features and all their components belong to the Rights Holder. The purchase of Additional Game Features does not transfer any exclusive rights to them to the User or the Recipient.
8.2. The Recipient may use the Additional Game Features only in the Game and within the rights granted by the Terms of Use.
8.3. The User and the Recipient may not:
- 8.3.1. sell or exchange for money or other values, or transfer outside the mechanics of the Game, Strikes and other Additional Game Features, as well as Game Profiles;
- 8.3.2. copy, distribute or otherwise use the Additional Game Features and their components outside the Game, except where expressly permitted by the Terms of Use;
- 8.3.3. use the functionality of the Store in ways not provided for by the Offer, including by automated means, or to circumvent the restrictions of the Website.
9. Liability and rights of the parties
9.1. Additional Game Features are intended for personal, family and other needs not related to business activity. Using them for business purposes may infringe the rights of the Rights Holder.
9.2. If the User or the Recipient gives third parties access to their Game Profile, they are responsible for the actions of those persons.
9.3. The User is liable for breaches of the Offer and their consequences in accordance with applicable law.
9.4. The Seller is liable for performing Crediting under a paid Order in the manner and within the periods set out in Section 6.
9.5. The Seller is not liable for improper use of the Additional Game Features by the User or the Recipient.
9.6. The Game and the Website develop and are updated, so the composition, form and list of Additional Game Features offered on the Store Website may change. This does not affect Orders already paid.
9.7. The Payment Provider is responsible for the operation of its services. The User may also address questions about processing a payment on its side to the Payment Provider.
9.8. To the extent permitted by applicable law, the Seller is not liable for the User's losses arising from:
- 9.8.1. incorrect completion of the Order, including entering and confirming a wrong Player ID or email address;
- 9.8.2. unlawful actions of the User;
- 9.8.3. unlawful actions of third parties.
9.9. The Parties are released from liability for full or partial non-performance of obligations if it is caused by force majeure circumstances that arose after the contract was concluded and that the Party could neither foresee nor prevent by reasonable measures, including:
- 9.9.1. failure of the equipment needed for the operation of the Website or the Game Server Side;
- 9.9.2. DoS/DDoS attacks and other attacks on the Website or the Game Server Side;
- 9.9.3. acts and decisions of public authorities making the further operation of the Store or Crediting unlawful;
- 9.9.4. failures of telecommunication and energy networks, the action of malicious software, unauthorised access to the hardware and software systems of the Parties.
9.10. A Party invoking force majeure notifies the other Party without delay: the User at support@snaystrike.com, the Seller via the Website or at the email address stated in the Order.
9.11. The period for performing obligations is extended for the duration of the force majeure circumstances and their consequences. If they last more than 60 (sixty) days, either Party may withdraw from the contract; in that case the payment received for an unfulfilled Order is refunded.
10. Dispute resolution and governing law
10.1. The Offer, the procedure for its acceptance, the contract concluded on its basis and the obligations related to it are governed by and construed in accordance with applicable law, subject to the mandatory consumer protection rules that apply to the User.
10.2. The Parties seek to resolve disputes by negotiation. A claim is sent in writing to the email address for legal matters (to be specified), stating the Order number, the Recipient's Player ID, the substance of the claim and the User's contact method.
10.3. The Seller answers a claim within: to be specified.
10.4. If a dispute is not settled by negotiation, it is resolved as follows: to be specified. This does not limit the User's right of recourse to the courts granted by the mandatory rules of applicable law.
11. Miscellaneous
11.1. The Seller may amend the Offer unilaterally by publishing a new version on the Website with the date of its entry into force. A new version applies to Orders created after it enters into force; each Order is governed by the version of the Offer in effect when the Order was created.
11.2. The User reviews the current version of the Offer before placing each Order.
11.3. The invalidity of any provision of the Offer does not entail the invalidity of the other provisions.
11.4. The Seller's failure to exercise its rights under the Offer in any case does not constitute a waiver of those rights.
11.5. The Seller may transfer its rights and obligations under the contract to a third party, notifying the User where required by applicable law. The User may not transfer the User's rights and obligations under the contract without the Seller's consent.
11.6. The Offer is published in Russian and English. In case of a discrepancy between the versions, the following prevails: to be specified.
11.7. Until real payments are launched, the Store operates in Test Mode: payment is simulated, no money is charged, no Strikes or other values are credited and no contract is concluded. Test orders have no economic effect in the Game.
